It is important that you should carefully read and understand the following Terms and Conditions. In this document you will find the working rules and guidelines for writers. Clearly understanding the rules and how they will be applied to you and the work you submit will help you develop more rewarding working environment.

INTERPRETATION
In this document:
"Company" or "our" or "us" mean and refer to Brownie Freelance Limited, a company registered under the laws of the United Kingdom, address: DEPT 706 19-21 Crawford Street, London, W1H 1PJ, England;
"Customer" mean and refer to any individual or corporate web user purchasing the Product from the Company through the Website;
"Paper" - an original written product that is drafted by You in accordance with these Terms and Conditions, including but not limited to: essay, academic paper, research, report, review and/or other creative products;
"Website" means www.ThePensters.com;
"Writer" or "you" or "yours" mean and refer to you and/or any other person who submits the Paper to the Company on your behalf.
TRANSFER OF COPYRIGHT
By posting or submitting the Paper to the Website, you transfer the copyright ownership for the Paper to the Company (including, without limitation, the exclusive rights to use, reproduce, edit, modify, adapt, publish, translate, distribute and/or sell the Paper in whole or in part in any and all forms and media, now or hereafter known).
By posting or submitting the Paper to the Website, you also warranty that the Paper is your original work, has not previously been published, and is not under consideration by another third party.
Good standing
By applying and participating in the Paper writing services provided through this Website, you are representing to us that you are a qualified writer in good standing. Providing false or incomplete information will result in being barred from the system and/or withholding of all payments due to the Writer under this Terms and Conditions.
Writer`s duties
You undertake to write essays, academic papers, complete researches, make reports, and do reviews on literature and speeches in a variety of different disciplines in accordance with the Customers requirements and these Terms and Conditions.
You shall regularly check your orders` page, email and news sections of the Website admin page.
You are also required to enrich your blog with new posts and keep your mini-CV along with the list of disciplines up-to-date.
The Company is not an employer of the Writer.
REQUIREMENTS FOR PAPERS. PAPER FORMAT
Each Paper must be in full compliance with the following requirements:
- Content should be of a high quality,
- The Customer`s requirements should be closely followed,
- The Paper should be correctly formatted,
- Content should be 100% original,
- All quotations must be properly referenced and attributed,
- Delivery of the Paper must be on time.
- A minimum of 275 words per page,
- Use of Arial or Times new Roman font 12 pt,
- Paper to be saved in Microsoft Word formats depending on the assignment,
- Paper must strictly follow a citation style (MLA, APA, Harvard, Chicago) determined by the Customer,
- Proper margins (1`` from each side),
- Double spaced lines,
- References and citations to ideas and/or information used,
- Footnotes and detailed or annotated bibliographies on customer`s demand,
- Good grammar and punctuation.
CALCULATING PAYMENTS TO WRITERS
Price for an order will be calculated according to the price in your profile + 40% extra charge for the service (for example, Writer`s bid is $100 while Customer pays $140). After registration Writer`s prices per page for different services (rewriting, proofreading, editing) are set by default and depend on academic level and deadline. Writers have an opportunity to set these prices themselves varying from $3 to $50 per page. It is important for each Writer to consider that the service adds 40% to the Writer`s bid, therefore, the price displayed to the Customer is 40% higher. If the Writer does not have any positive grades yet, it is essential to adhere to default prices, improve the rating and only then start increasing/decreasing the price for enlarging the number of Customers.
All of the Writers have and opportunity to automatically participate in the Partner program, due to fact that their blogs can be traced back by online users through such Internet search systems as Google. This is a profit sharing program for every Customer. When Customer visits our Website for the first time, the reviewed web page gets immediately traced and fixed.

the Customer will be assigned to you per lifetime condition. The Writer, who has appealed to this Customer will get 30% of the extra charge for the order.
For example, Customer uses your link to access the Website. He/she orders a Research Paper of Master`s level and the Writer (which is not obligatory you) will get $100 for completing the order, while the Customer pays $140. You will get $12 (30% of the extra charge of $40) right after the order is approved by the Customer. If the order is refunded, the payment will be cancelled.
Payment for the order is received by the Writer after approval of each part of the order.
Approval of the first part of the order will result in the Writer`s payment CORRESPONDING to the price for the approved part only! According to our Terms and Conditions along with the Money Back Guarantee Customer will not be eligible to refund the payment for the part approved.
REVISIONS
Whenever the Customer is not satisfied with the quality of the Paper (to be proven) he/she can ask for a revision. The Writer shall complete the revision within a defined period of time.
If the Paper fails to comply with the initial requirements of the Customer, the revision is done without extra payment to the Writer. Revisions may be additionally paid if the Customer changes his/her initial requirements.
It is mandatory for the Writer to complete the revision. In case of retracting from revision, writer`s payment may be recalculated based on a reason for retract. Each request for not writing a revision is assessed as a unique case and is treated individually.
OUTLINES AND ABSTRACTS
If the Customer requires for an outline or synopsis either in writing or in a Power Point presentation, these should be completed by the Writer according to the Customer`s requirement without extra payment to the Writer.
This usually includes title pages, outlines, bibliographies and abstracts.
PAYMENT DETAILS
The Writer has an option of withdrawing his/her current balance twice per month, in particular, on the 1st and 15th day of each month. Writer`s billing overview will be prepared and provided for thorough evaluation. After the Writer confirms this payment an invoice of a standard form will be generated and saved in Company`s files. This invoice will be considered as legal document that the Company can use for Company`s accounting statements. Under no circumstances the Company shall be liable for the Writer`s failure to fill and/or submit an invoice to withdraw due amounts.
Any Paper that has reached the "Completed Orders List" in the Website during those assessment periods will become eligible for payment.
The Writer will be able to view her/his payment details in "My Earnings" tab of the Billing section.
The Writer may receive the payment for the completed Paper within 1-5 days period after the Company receives properly filled and submitted invoice. The payment period depends on the payment method selected by the Writer in the invoice.
PAYMENT INSTRUCTIONS
You agree to bear all and any costs related to the transfer of payments from the Company to you (including fees or commissions charged by banks and transfer agents).
To receive any payments from the Company you may choose the following options:
- Paypal and MoneyBookers: you should provide the Company with your Paypal or Moneybookers account email address, or
- Prepaid Debit MasterCard®, Powered by Payoneer: you should register at Payoneer.com through your home page inside our system. After you will receive the card, you will be getting your funds directly to your card, or
- Wire transfer: this option is available for payouts starting at $500. If you have amount that is less than $500, please use other options.
In order to complete the payment we will need the following details:

Attention: If some problems because of wrong Wire transfer details appear, we will have to change writer`s payment method to Payoneer without any exceptions. So, please, be very attentive with your SWIFT code, Account Name and Account Number.
We can not be held responsible if the bank details that you have supplied to us are insufficient or incorrect. In such case you will bear any bank fees and commissions charged for the recall of transfer and/or changes in the details of payment.
PAYMENTS WITHHELD
You agree that ten percent of each payment due to you will be normally withheld. So you will initially receive 90% of each fee due to you.
The withheld amount will be paid out upon the expiry of 90-days period.
The reason for the withholding policy is to provide a pool of funds to assist with the expansion of the business through promotions. This activity benefits both the Company and the Writers, as it generates more Customers and hence more work for our writers.
We have additionally found that the withholding promotes a better responsibility among our writers to help with any rewrites, which results in fewer cancellations and therefore greater continuity in the workflow (and payments) for our writers.
PENALTIES AND FINES
- for wrong paper format,
- for lateness of the paper due to your own fault,
- for wrong paper uploaded,
- for public display of your contact/personal information,
- for refusal to complete revision when initial instructions are not changed,
- for retraction of the bid.
PERSONAL INFORMATION
- should not be displayed on the Website. For example, no contact information (email, phone number, etc.) should be included in your personal mini-CV,
- according to the above mentioned condition communication with the Customer avoiding thePensters.com messaging system is also prohibited.
Order Modification
General scheme of order modification:
1. Customer and Writer agree on modifications of number of pages and/or total deadline along with the corresponding price for the order.
2. Customer places another order for rewriting with the request for the same Writer.
3. Writer confirms the request.
4. Customer completes the payment for confirmed order.
5. Writer completes the assignment, Customer receives the order.
CANCELLATION
Before approval of PDF pre-view version (part of the paper) Customer is able to cancel the completion of the order (part of the order). The payment for approved parts of the order will not be refunded to the Customer, neither it will be withdrawn from the Writer.
DISABLED POLICY, INDEMNIFICATION, LIMITATION OF LIABILITY, JURISDICTION, MODIFICATION OF TERMS, SEVERABILITY

We maintain a policy of non-discrimination and actively welcome any qualified persons to apply for a writing or editorial position. Our only objective is to seek excellence in the work we perform for our customers.
INDEMNIFICATION
You agree that you are solely responsible for the content of the Paper submitted to the Company and/or its Customers, and that you agree to indemnify and hold harmless the Company, its owners and employees with respect to any claims based upon the Papers submissions to the Company and/or its Customers.
LIMITATION OF LIABILITY
THE COMPANY SHALL NOT BE LIABLE TO A MEMBER, VISITOR, USER OR ANY OTHER PERSON OR ENTITY FOR ANY DAMAGES THAT RESULT FROM THE USE OF, OR THE INABILITY TO USE, THE WEBSITE, FOR RELIANCE ON THE INFORMATION CONTAINED IN THE WEBSITE, SUPPORT SERVICES, OR FOR ANY CONSEQUENTIAL, INCIDENTAL, INDIRECT, PUNITIVE, SPECIAL, OR SIMILAR DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
THE COMPANY, ITS AFFILIATES, ANY OFFICER, DIRECTOR, EMPLOYEE, SUBCONTRACTOR, AGENT, SUCCESSOR, OR ASSIGN OF THE COMPANY OR THEIR AFFILIATES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND WHATSOEVER (INCLUDING, WITHOUT LIMITATION, ATTORNEY`S FEES AND LOST PROFITS OR SAVINGS) IN ANY WAY DUE TO, RESULTING FROM, OR ARISING IN CONNECTION WITH THIS WEBSITE, INCLUDING ITS CONTENT.
JURISDICTION
These Terms and Conditions shall be governed by and construed in accordance with the laws of England.
MODIFICATION OF TERMS
These Terms and Conditions may be modified by us at any time without prior notice. The Website may contain links to other websites for which the Company does not maintain control. Any concerns regarding any such service or resource, or any link thereto, should be directed to the particular service or resource. Continued use of this Website following any change constitutes your acceptance of the change.
SEVERABILITY
